1. Who is responsible
Merch5 Inc, 220 E 23rd St, Office 400, New York, NY 10010, United States, decides how the data described here is handled. Write to hello@merch5.com about anything on this page.
For data about a seller — the account, the stores, the payouts — we are the controller. For data about a buyer who orders from a seller's store, the seller decides what to sell and to whom, and we process order data to produce and deliver the parcel.
2. What we collect
From sellers:
- account details: name, email, password hash, company name and billing details
- store content: designs you upload, product selections, prices and store settings
- payout details needed to send you money
- usage data: pages and features used in the app, device and browser, IP address
From buyers, when someone orders from a store built on Merch5:
- name, delivery address, email and phone where the carrier needs it
- the contents of the order and its production and delivery status
- payment confirmation from the payment provider — we never see or store full card numbers
From visitors to merch5.com: the request data every web server records, and nothing else. This marketing site sets no advertising or analytics cookies. Web fonts are loaded from Google's servers, which means Google receives the request for the font file.
3. Why we use it
- to run your account, your stores and the widget
- to produce, pack, ship and track the orders your customers pay for
- to calculate and send your payouts
- to answer support requests and resolve print or delivery problems
- to keep the platform secure and to detect fraud and abuse
- to meet accounting, tax and other legal obligations
We do not sell personal data, and we do not add your customers to any marketing list of ours.
4. Who it is shared with
- printing partners — the production facility nearest the buyer receives what it needs to produce and label the parcel
- carriers — the delivery address and contact details needed to deliver and to let the buyer track the parcel
- payment providers — to take the buyer's payment and to send your payout
- service providers that host, back up and secure the platform on our behalf
- authorities, when the law requires it
Everyone in that list gets the minimum they need for their part of the job and is bound to use it for nothing else.
5. Where it goes
We ship to more than 100 countries and print on several continents, so order data crosses borders by design: an order from Berlin is produced in Europe, an order from Texas in the United States. Where data leaves the EEA or the UK, it is transferred under the safeguards those laws require.
6. How long we keep it
- account and store data: while the account exists, then deleted or anonymised
- order and payout records: as long as accounting and tax law requires them to be kept
- uploaded designs: until you remove the item, except for the copies attached to past orders
- support correspondence: while it is useful to resolve a recurring problem, then deleted
7. Your rights
Depending on where you live you can ask us for a copy of your data, ask us to correct it, delete it, limit what we do with it, or object to it. You can also ask for it in a portable form.
Write to hello@merch5.com and we will answer within the period the law allows. If you are a buyer rather than a seller, start with the store you bought from — they know the order and can reach us about it.
If you are in the EEA or the UK you can complain to your data protection authority. If you are in California, you have the rights the CCPA gives you, including the right not to be discriminated against for using them.
8. Security
Data travels over encrypted connections, access inside the company is limited to the people who need it, and payment card data never reaches our servers. No system is perfect; if a breach affects you, we will tell you and the regulator as the law requires.
9. Children
The platform is for businesses and adults. We do not knowingly collect data from children under 16. If you think we have, write to us and it will be deleted.
10. Changes
When the service changes, this page changes with it. The date at the top is the current version, and a meaningful change is announced in the app or by email before it takes effect.
